At the same time, the Labour Department can help the employee recover outstanding compensation payment(s) from the employer. It can also investigate doubtful employees\u2019 compensation claims for the employer or insurance company.[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;container&#8221; padding_top=&#8221;&#8221; padding_bottom=&#8221;&#8221;][vc_column][vc_separator color=&#8221;#666666&#8243; type=&#8221;normal&#8221; thickness=&#8221;&#8221; up=&#8221;&#8221; down=&#8221;&#8221;][\/vc_column][\/vc_row][vc_row type=&#8221;container&#8221; padding_top=&#8221;&#8221; padding_bottom=&#8221;&#8221;][vc_column][vc_column_text]2. \u00a0Q: Under what circumstances should an injured employee claim compensation through the court?<\/p>\n<p>A: The following circumstances:<\/p>\n<ul>\n<li>Employer (or insurance company) disputes liability<\/li>\n<li>Employer defaults in payment without good reasons or the company closed down<\/li>\n<li>There is dispute as to compensation items, such as \u201carea of injury\u201d, \u201csalary calculation\u201d and \u201cmedical assessment result\u201d etc.<\/li>\n<li>It takes probably more than 2 years to deal with the case<\/li>\n<li>After getting medical assessment for two times, the employee is still unsatisfied with the result<\/li>\n<li>The case required application for Employees\u2019 Compensation Assistance Fund<\/li>\n<\/ul>\n<p>If any of the first three scenarios above is applicable, you may first seek assistance from the Labour Department to resolve the case.
